4. Settlement Agreements
A Settlement Agreement is an agreement that allows you to AGREE with an employee the terms under which they will leave the Company.
Settlement Agreements provide a process and mechanism to allow you to have a discussion with an employee about their possible exit from the business without the need to go through lengthy procedures. This may include where there is a performance or conduct issue with an employee, and you don't want to have to go through lengthy and time-consuming procedures. However, an employee does NOT have to agree to a settlement agreement, so you need to be prepared to follow the right procedure if necessary.
